These Terms of Service (“Terms”) govern your access to and use of the website, platform, and services (collectively, the “Service”) operated by 5K CERTIFIED LLC (“5K CERTIFIED,” “we,” “us,” or “our”). By accessing or using the Service, you agree to be bound by these Terms.

1. Nature of the Service

5K CERTIFIED provides independent authentication opinions for luxury fragrance. An authentication opinion is a professional judgment, based on the materials available for review, that an item is consistent or inconsistent with authentic production. It does not constitute a government or brand endorsement, a retail valuation, an appraisal, or investment advice.

2. Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent that you meet this requirement and that any information you provide is accurate and complete.

3. Your Submissions

You retain ownership of any images or materials you submit. You grant us a limited, non-exclusive license to use those materials solely for the purpose of providing the authentication service to you. You represent that you have the right to submit the materials and that doing so does not violate any third-party rights or applicable law.

4. Fees and Payment

Fees are displayed at the point of order and are due at the time of submission. All fees are in U.S. dollars unless otherwise stated. Failure to pay may delay or prevent performance of the Service.

5. Refunds

Refunds are governed by our Refund Policy, which is incorporated into these Terms by reference.

6. Disclaimer of Warranties

The Service is provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. Authentication opinions are professional judgments provided in good faith but are not guaranteed to be free from error.

7. Limitation of Liability

To the maximum extent permitted by law, 5K CERTIFIED LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or revenues, arising out of or relating to your use of the Service, whether in contract, tort, or otherwise, even if advised of the possibility of such damages. Our total liability arising out of or relating to the Service shall not exceed the fees you paid for the specific service giving rise to the claim.

8. Intellectual Property

The Service and its content, including the 5K CERTIFIED name and marks, are owned by5K CERTIFIED LLC and are protected by applicable intellectual property laws. All brand names referenced on the Service are the property of their respective owners and are used solely for identification.

9. Prohibited Conduct

• Using the Service for any unlawful purpose.
• Submitting materials you do not have the right to submit.
• Attempting to interfere with, disrupt, or gain unauthorized access to the Service.
• Misrepresenting the results of an authentication opinion.

10. Termination

We may suspend or terminate your access to the Service at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users or to us.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New Jersey, without regard to its conflict-of-law provisions.

12. Changes to These Terms

We may update these Terms from time to time. We will post the revised Terms on this page with an updated “Last updated” date. Your continued use of the Service after such changes constitutes acceptance of the revised Terms.
